Doctor convicted of the death of 4-year-old Karine from Armavir fully pleads guilty and is ready to provide material compensation

On September 5, 2017 a next-in-turn court hearing was scheduled on the case of 2-year-and-3-month-old Lia Misakyan who died in ‘Arabkir’ Medical Center in January 2013, after the RA Cassation Court sent the case to re-examination.
In the former, the representative of ‘Arabkir’ Medical Center stated that the damage was not caused by the fault of the Medical Center; it was not considered a public institution and should not provide any compensation in the sense of the RA Civil Code. Also, the Medical Center’s representative does not consider reasonable the amount of the moral damages and asks the Court to reject the claim.
Witnesses questioned on the case of causing serviceman to commit suicide insist that they were guided by the investigator
Witness A. Sargsyan said that after consulting a lawyer, he realized that he might change his testimonies provided during the preliminary investigation and decided to tell the truth during the confrontation. Upon the motion of the prosecution party, the Court disclosed the testimonies of the witness given during the preliminary investigation and then the parties asked questions on the contradictions.
On July 23, 2017, in the evening, the RA Ministry of Defense shared information stating that on July 23, 2017, at about 6:30 am, in the area near the RA MoD military unit № N, the body of junior sergeant, conscript soldier Vardan Melkonyan /father’s name: Artavazd/ who voluntarily left the unit, was found hung (born in 1998, Vanadzor Military Registration and Enrollment Office). To establish the circumstances of the case, investigation is in progress.
Successor of Lia Misakyan who died at ‘Arabkir’ Medical Center in 2013 demands material and moral damage compensation from doctors
On June 8, 2017 the General Jurisdiction Court of Kentron and Nork-Marash administrative districts started examination of the claim for material and moral damage compensation of G. Misakyan, successor to 2-year-and-3-month-old Lia Misakyan who died at ‘Arabkir’ Medical Center on January 2, 2013.
By their claim, G. Misakyan and his representatives, Arayik Zalyan and Ani Chatinyan, lawyers at HCA Vanadzor, demand seizing from ‘Arabkir’ Joint Medical Center – Institute of Child and Adolescent Health LLC and L. Vardanyan and Z. Ayvazyan, doctors at ‘Arabkir’ Medical Center, 15,000.000 AMD for moral damage and 1,690.000 AMD as material damage.
Contradiction in the testimonies of the victim under the case of the serviceman who committed suicide: preliminary testimonies were disclosed
On June 8, 2017 the RA General Jurisdiction Court of Syunik marz (region) carried on examination of the case of Gevorg Khachatryan who committed suicide at a military unit of the RA NSS border guard troops on November 28, 2015.
On May 26, 2017 the General Jurisdiction Court of Syunik marz (region), RA, presided by judge N. Ohanyan, started examining the case of Gevorg Khachatryan who committed a suicide on November 28, 2015 at a military unit of the RA National Security Service border guard troops.
The court judgment on Anahit Petrosyan, Head of the Infectious Diseases Unit of Armavir Medical Center, charged with the death of young Karine Hovhannisyan and Erik Amirkhanyan, under which she was found guilty of committing an action under Article 130(2) /failure to fulfill or properly fulfill professional duties by medical care and service personnel, which caused through negligence the patient’s death/ of the RA Criminal Code and sentenced to 3 years of imprisonment and deprived of the right to practice professional activities for a term of 1 year and 6 months took effect.
HCA Vanadzor lawyer Arayik Zalyan, representative of the successor of 2-year-and-3-month-old Lia Misakyan who died at ‘Arabkir’ Medical Center on January 2, 2013, filed with the European Court of Human Rights a complaint on violation of Article 2 (Right to life) and Article 13 (Right to effective legal remedy) of the European Convention of Human Rights.
On April 3, 2017, the General Jurisdiction Court of Arabkir and Kanaker-Zeytun administrative districts of Yerevan, RA, had a scheduled next-in-turn court hearing under the examination of Lia Misakyan’s death.
