The decision of the body conducting the proceedings dated February 4, 2019, partly upheld another petition made by Helsinki Citizens’ Assembly Vanadzor chairman Artur Sakunts and the Organization’s lawyers Arayik Zalyan and Hayk Hakobyan – representatives of the successor of Gyumri resident Julieta Ghukasyan in the latter’s death case.
On January 25, 2019, A. Sakunts, A. Zalyan and H. Hakobyan made a petition to the body conducting the proceedings to perform certain investigative and procedural actions, including ordering an expertise in order to verify the condition of the accused person using drugs.
The RA Investigative Committee Shirak regional Investigative Department deputy head V. Samvelyan decided to partly uphold the petition, since some actions mentioned in the petition had already been performed or were being performed.
With regard to ordering an expertise to find out the condition of A. Razgildeyev using drugs, V. Samvelyan stated that the accused person refused to provide a pattern, therefore, the expertise is impossible to conduct.
We should remind that the body conducting the proceedings and later also the RA Shirak region Prosecutor Karen Gabrielyan had earlier rejected another petition of the injured party pertaining to the matter of transferring A. R. from the Russian military base to the RA penitentiary institution. This decision is currently being appealed in the RA Shirak region General Jurisdiction Court. The next court case is set on March 15, 2019.
