The injured party still does not have any official information regarding the criminal case initiated on the basis of the failure to provide Edgar Tsatinyan with proper medical aid. Edgar Tsatinyan died in “Armenia” MC on April 8, 2019, after being transferred from the police division to hospital.
Let us remind that on April 15, 2019, a criminal case was initiated on the basis of torture (point 4 and point 7 of Article 309.1 part 2 of the RA Criminal Code) in the RA Special Investigation Service. Larisa Yetaryan -E. Tsatinyan’s mother – was recognized as the victim’s successor within the framework of the initiated criminal case, and Helsinki Citizens’ Assembly Vanadzor lawyer Arayik Zalyan was recognized as her representative.
The injured party was informed by the Special Investigation Service about the criminal case initiated on the basis of the failure to provide proper medical aid. However, the case is initiated not in the Special Investigation Service, but in the RA Investigative Committee Avan and Nor Nork administrative districts investigative division.
It should be noted that in their conversations with media, E. Tsatinyan’s family members mentioned several times that he had not been provided with proper medical aid, had not undergone the necessary examinations and no interference was made, as a result of which he died.
On April 17, 2019, A. Zalyan filed a complaint to the RA Prosecutor General Artur Davtyan claiming to make available for the injured party the criminal case initiated on the features of the failure to implement or improper implementation of professional duties by those providing medical aid and service and transfer the examination of the case in its full volume to the RA Special Investigation Service.
Among other claims about improper medical aid, in the application addressed to the Prosecutor General’s Office, A. Zalyan mentioned the photos of E. Tsatinyan taken in the latter’s ward, in which it is apparently visible that there was a tie wrapped around his hand. A. Zalyan presented questions regarding the details of the medical aid provided and also underscored the fact that “Armenia” MC did not make a report on E. Tsatinyan’s death to the Police, despite the fact that it had the obligation to do so.
No response has been received from the Prosecutor General’s Office yet.
