“Decent work now” success stories resulting from the provided legal support continue.
With HCAV’s legal support, the right to fair remuneration of 40 applicants in employment relations with the same organization, and 11 applicants in employment relations with a different organization was restored. In 2023, the mentioned employees applied to HCAV, stating that they had claimed their salary from their employer many times, while the employer still continued not to pay their salary. These citizens requested HCAV’s legal support (and also mentioned they had had unpaid salary in 2014). HCAV undertook to protect the applicants’ rights and provided legal support to them in terms of preparing and submitting applications addressed to the RA Health and Labor Inspectorate on initiating administrative proceedings. Based on the lodged applications, the Health and Labor Inspectorate initiated administrative proceedings and upheld the applications, the applicants’ violated labor rights were restored. Below are the summed up results.
The total amount of salaries claimed by the first application was AMD 1.424.8911. The total amount of salaries paid to 11 applicants as a result of the initiated administrative proceedings was AMD 1.513.000.
The total amount of salaries claimed by the second application was AMD 6.259.815. The total amount of salaries paid to 29 applicants as a result of the instituted administrative proceedings was AMD 5.889.693.
The total amount of salaries paid to 11 applicants as a result of the administrative proceedings instituted in the frame of the third case was AMD 4.131.000.
In the frame of the 3 instituted cases, the total amount of salary debt paid as a result of administrative proceedings instituted by the Health and Labor Inspectorate on account of the applications lodged by 51 employees was AMD 11.533.693, of which AMD 7.402.693 was paid by one legal person, and AMD 4.131.000 was paid by a different legal person.
Summing up, we can record that in the frame of the Health and Labor Inspectorate’s power of overseeing the calculation and payment of salaries, the time and financial resources required for protecting an employee’s right to fair remuneration was significantly reduced. The acting regulations allow for protecting labor rights by applying to the Health and Labor Inspectorate before applying to court.
